(ONTARIO) SUPERIOR COURT OF JUSTICE

TO: BRIAN ROSS

An action has been commenced against you in this Court by Mark Kapush in which his claim is for damages in connection with an assault that occurred upon him on or about the 15th day of May, 2005, while at a local establishment. This assault was totally unprovoked. The Plaintiff is claiming general damages in the amount of $2,500,000.00, aggravated damages in the amount of $2,500,000.00, special damages in the amount of $2,500,000.00, both prejudgment and postjudgment interest and costs of this action together with applicable Goods and Services Tax.

It has been ordered that service of the Statement of Claim on you be effected by this advertisement. If you wish to defend the action, you or an Ontario lawyer acting for you must prepare a Statement of Defence in Form 18A prescribed by the Rules of Civil Procedure, serve it on the Plaintiff‘s lawyer at the address shown below, and file it, with proof of service, in the office of the (Ontario) Superior Court of Justice at 277 Camelot Street, Thunder Bay, Ontario, P7A 4B3.

IF YOU FAIL TO DEFEND THIS ACTION, JUDGMENT MAY BE GIVEN AGAINST YOU IN YOUR ABSENCE AND WITHOUT FURTHER NOTICE TO YOU.
